This document outlines the Terms and Conditions ("T&C") governing our provision of services, which encompass entertainment events, guided excursions, and pre-party gatherings ("Services"). By booking, accessing, or participating in any aspect of our Services, you acknowledge the inherent risks of this untamed environment and agree to be bound by these T&C. These T&C take effect on August 21, 2025, reflecting the evolving spirit of our operations and the legal landscape of Suriname. We may revise them periodically, with updates posted on our website or communicated via email. Your continued engagement with our Services after such notification signifies your acceptance of the refreshed terms, ensuring we're all navigating the same current.
3. Jurisdiction
These T&C are governed by the laws of the Republic of Suriname, drawing from its Civil Code (as updated by the New Civil Code effective May 1, 2025, which modernizes contract and liability provisions) and other applicable statutes. In the absence of specific Surinamese provisions, we reference international principles, such as those in the UNWTO International Code for the Protection of Tourists (2024), to uphold fair standards in tourism liability and consumer rights. Any disputes arising from or connected to these T&C or our Services shall be resolved exclusively in the competent courts of Paramaribo, Suriname, our primary operational hub, fostering resolution in the land where our adventures unfold.

This encompasses, without limitation, personal injury, loss of data, income, profit, property damage, or third-party claims.
Libi Da Wai, an island oasis in the Brokopondo Reservoir, offers gentler currents but remains a realm of raw beauty with inherent perils: jungle terrains, wildlife, unpredictable weather, and remote access that may delay emergency responses. Our pre-parties at Wan Bon and the festival at Libi Da Wai amplify this with music and revelry, but you assume full responsibility for your actions and their outcomes. Specifically:
Swimming and Water Activities: The reservoir waters around Libi Da Wai, though generally navigable, may conceal hazards like submerged obstacles or wildlife. By swimming, you affirm your proficiency and accept all risks, including injury or drowning, without holding SuUnderground accountable.
Substance Use and Behavior: Suriname enforces stringent drug laws under the Narcotics Act (Law of February 12, 1998, Staatsblad 1998 no. 14), with severe penalties for possession, use, or trafficking, including fines, imprisonment, or life sentences. SuUnderground strictly prohibits providing illegal drugs and limits alcohol distribution to promote safety. You are solely responsible for any substances you choose to bring or consume, despite our warnings against illegal or reckless behavior. Any consequences—health issues, injuries, or legal repercussions from intoxication or drug use—are your responsibility, not ours. We explicitly warn against actions that endanger yourself or others, and you bear full liability for any reckless acts committed after such advisories.
In line with international norms where Surinamese specifics are silent, such as the UNWTO Code, we prioritize safety but emphasize your duty to act prudently amid the festival's energy and the island's enigmas.
5. Rules of Conduct
Our events at Libi Da Wai and Wan Bon thrive on harmony between thrill-seekers, nature, and community, much like the reservoir's delicate balance. You pledge to abide by all Surinamese laws, including environmental protections under nature reserve regulations (punishable by up to three months' imprisonment or fines), and international norms. Violations disrupt the ecosystem we cherish and may lead to immediate termination of your access, at our discretion, with you bearing full responsibility for ensuing damages.
Key commitments include:
Refraining from dangerous activities, such as unsupervised swimming or reckless behavior under the influence, that endanger yourself or others.
Preserving the flora, fauna, and indigenous communities—disturbance could invoke penalties under Surinamese environmental laws.
Heeding all directives from our guides and staff, whose expertise ensures safety during the festival and pre-parties.
Avoiding actions that tarnish SuUnderground's reputation, such as disruptive behavior or unauthorized filming of sacred sites.
Your participation affirms your understanding: the island and our festival reward the responsible but punish the heedless.
6. Refund Policy
Life's plans can shift like the reservoir's tides, and we strive for flexibility within our operational realities. Aligned with emerging Surinamese consumer protection frameworks (such as the draft Consumer Protection Act and Decree E-47 on price controls), our policy is as follows:
Full Refund: Cancel at least seven (7) days prior to the event start (whether at Wan Bon or Libi Da Wai) for a complete reimbursement, processed via your original payment method. Contact our team in writing for confirmation.
No Refund: Cancellations within seven (7) days forfeit refunds, accounting for irrevocable preparations like permits, stage setups, and provisions.
Refunds process within fourteen (14) business days. Exceptional cases (e.g., force majeure like floods) may warrant discretion, but we're not obligated. This policy integrates fully with these T&C, ensuring transparency in our shared journey.
7. Indemnification

Act with care: avoid risks like excessive intoxication that imperil others, and heed our zero-tolerance policy for illegal drugs under Surinamese law—violations invite expulsion and potential prosecution. In the reservoir's waters, acknowledge potential hazards despite safer currents; you're liable for your choices. Our staff will warn against unsafe behaviors, but any consequences from ignoring these advisories rest solely with you.
On Libi Da Wai, a first aid post will be available for assistance. To keep everyone safe, please follow these simple rules:
Don’t swim too far.
Never swim alone in the dark.
Let someone know when you go exploring.
Don’t eat in the water.
Do not attempt to swim to other islands.
Together, these measures ensure the festival remains not only unforgettable, but also safe for all.
11. Dispute Resolution
Should discord arise, like a storm over the reservoir, we favor resolution through binding arbitration over court battles. Conducted by a neutral arbitrator under Surinamese arbitration rules (or, if unspecified, international standards like those of the UNCITRAL Model Law), this process ensures swift, fair outcomes. Judgments are enforceable in competent courts, allowing us to refocus on the adventures at Libi Da Wai and Wan Bon.
